2021年(nian)7月,劉(liu)先(xian)生(sheng)通过宠物托运公(gong)司(si)运營(ying)的某(mou)微(wei)信(xin)小程序下单办理宠物托运,将心(xin)愛(ai)的“毛(mao)孩(hai)子(zi)”——一只(zhi)購(gou)入(ru)價(jia)10,500元(yuan)的法國(guo)鬥(dou)牛(niu)犬(quan)从深圳运往河南。

刘先生下訂(ding)单时,在(zai)平台上勾(gou)選(xuan)同意《运输契(qi)約(yue)條(tiao)款(kuan)》。該(gai)合同约定,平台系(xi)提(ti)供(gong)物流(liu)資(zi)源(yuan)服(fu)務(wu)的網(wang)絡(luo)信息平台。宠主在平台提交(jiao)订单成功(gong)後(hou),在平台註(zhu)冊(ce)的宠运商(shang)将為(wei)其(qi)提供后續(xu)的宠物托运服务。宠运商執(zhi)行(xing)平台統(tong)一的服务規(gui)範(fan),並(bing)對(dui)服务期間(jian)的服务質(zhi)量(liang)負(fu)责。运输方式若(ruo)选擇(ze)宠物专车的,在途(tu)中因乘(cheng)车環(huan)境(jing)和(he)服务導(dao)致(zhi)宠物意外身(shen)亡,宠运商應(ying)对宠主進(jin)行赔付(fu),宠运商以运费3倍(bei)(包(bao)含(han)运费)作(zuo)为最(zui)高赔偿条件。

平台注册宠运商樂(le)女(nv)士(shi)接(jie)受(shou)订单并提供報(bao)价,刘先生隨(sui)即(ji)向(xiang)平台支(zhi)付运费688元,雙(shuang)方约定送(song)宠方式为宠物专车。

然(ran)而(er)在运输途中,乐女士一方擅自改變(bian)运输方式,从原(yuan)定宠物专车改为大巴客车托运,导致到达目的地时刘先生宠物狗因空(kong)氣(qi)不(bu)流通窒(zhi)息死亡。随后,乐女士向平台赔付兩(liang)倍运费即1,376元,平台遂(sui)向刘先生退回全(quan)额运费688元,并向刘先生賬(zhang)戶(hu)支付1,376元赔付款。

刘先生不滿(man)平台的處(chu)理结果(guo),協(xie)商無(wu)果后,起(qi)訴(su)至(zhi)奉贤区人民法院,要(yao)求(qiu)平台公司另(ling)行赔偿刘先生宠物损失9,124元。审理中,平台公司披(pi)露(lu)了乐女士主體(ti)信息,人民法院依(yi)刘先生申(shen)請(qing)追(zhui)加(jia)乐女士为本(ben)案的共(gong)同被告(gao)。后,刘先生变更诉訟(song)请求,要求平台公司和实际承运人乐女士共同赔偿刘先生宠物损失9,124元。

平台公司辯(bian)称,平台公司系信息服务平台的中介(jie)人,刘先生和平台公司之(zhi)间是中介合同關(guan)系,并非(fei)运输合同关系。刘先生宠物死亡是乐女士擅自变更运输方式造(zao)成的,平台公司已經(jing)第(di)一时间退还运费并按(an)照(zhao)合同约定向刘先生支付两倍运费,平台公司的義(yi)务已经履(lv)行完(wan)畢(bi)。

乐女士辩称,刘先生的宠物在运输前(qian)已经气喘(chuan)嚴(yan)重(zhong),且(qie)刘先生沒(mei)有(you)提供獸(shou)醫(yi)開(kai)具(ju)的健(jian)康(kang)證(zheng)明(ming)。由(you)於(yu)没有直(zhi)达的宠物专车,乐女士一方當(dang)时没有告知(zhi)刘先生就(jiu)将宠物运输方式变更为大巴运输。刘先生的宠物死亡后,乐女士未(wei)收(shou)取(qu)运费并且向平台支付了两倍的运费,已经符(fu)合平台的最高赔偿標(biao)準(zhun)。

奉贤区人民法院经审理認(ren)为,乐女士作为运输合同实际承运人应对免(mian)责事(shi)由承担舉(ju)证责任,如不能(neng)举证证明存(cun)在《民法典(dian)》第八(ba)百(bai)三(san)十(shi)二(er)条规定的免责事由,則(ze)应对运输过程中的损失承担赔偿责任。

乐女士雖(sui)辩称刘先生的宠物狗在运输前已经气喘严重,但其提供視(shi)頻(pin)等(deng)证据不足(zu)以证明刘先生的宠物狗在托运前存在不良(liang)健康狀(zhuang)況(kuang),况且,其擅自变更运输方式存在过錯(cuo),其不能证明存在《民法典》第八百三十二条的免责事由,故(gu)不能免除(chu)其赔偿责任。

宠物托运公司作为提供物流资源服务的网络信息平台,其促(cu)成了刘先生與(yu)乐女士之间的运输合同关系;且,其已经披露承运人乐女士的主体信息,使(shi)得(de)刘先生可(ke)向乐女士主張(zhang)赔偿责任,故刘先生主张平台公司承担赔偿责任,缺(que)乏(fa)事实和法律(lv)依据,不予(yu)支持(chi)。

关于该案的赔偿金额,《运输契约条款》作为格(ge)式条款,三倍运费赔偿条款(包含运费)并未采(cai)用(yong)字(zi)体加大加粗(cu)或(huo)者(zhe)其他(ta)特(te)別(bie)提示(shi)。盡(jin)管(guan)刘先生对条款进行了勾选,亦(yi)不能认定平台已经依法履行了適(shi)当及(ji)合理的提示义务。刘先生购買(mai)宠物狗的价格在一萬(wan)余(yu)元,契约条款约定的三倍运费赔偿条款(包含运费)明顯(xian)減(jian)輕(qing)了承运人的责任、限(xian)制(zhi)了托运人的權(quan)利(li),显失公平。故三倍运费赔偿条款不应适用。乐女士应按照购买价格10,500元进行赔偿。扣(kou)除已经支付給(gei)刘先生的1,376元,最終(zhong)奉贤区人民法院判決(jue)乐女士赔偿刘先生9,124元。

一审判决作出(chu)后,乐女士不服判决提起上诉,上海市第一中级人民法院经审理后判决駁(bo)回上诉,維(wei)持原判。

【法官說(shuo)法】

宠物托运人勾选合同条款时,需(xu)准确識(shi)别平台性(xing)质

奉贤区人民法院商事庭(ting)二级法官王(wang)文(wen)霞(xia)提示,目前,宠物托运平台主要有两種(zhong)运营模(mo)式,相(xiang)对应的运输合同的责任主体不同,宠物托运人需准确识别。

一种是宠物托运平台以无车承运人的身份(fen)与托运人订立(li)宠物托运服务合同,此(ci)时平台与托运人之间成立貨(huo)物运输合同关系,平台应当按照《民法典》第八百三十二条的规定对运输过程中货物的毀(hui)损、滅(mie)失承担赔偿责任。

另一种是宠物托运平台以信息中介的身份与托运人、承运人订立宠物托运服务合同,宠物托运平台为托运人和承运人提供订立合同的機(ji)會(hui),其身份系信息中介,并非运输合同的承运人。在平台接单的实际承运人与托运人之间成立货物运输合同关系,实际承运人应当按照《民法典》第八百三十二条的规定对运输过程中货物的毁损、灭失承担赔偿责任。

实际承运人应恪(ke)守(shou)合同约定,安(an)全运输宠物

在平台系信息中介的情(qing)况下,平台上接单的实际承运人对宠物负有安全运输的义务。在托运人将宠物交付给实际承运人后,实际承运人若无法证明宠物的毁损、灭失是因不可抗(kang)力(li)、宠物本身的自然性质或者合理损耗(hao)以及托运人、收货人的过错造成的,则需对承运宠物的毁损、灭失负赔偿责任。

宠物托运平台合同条款提示缺位(wei),应当完善(shan)提示和说明方式

尽管托运人同意勾选宠物托运合同条款,但合同对赔付标准等影(ying)響(xiang)托运人权利的关鍵(jian)內(nei)容(rong)大多(duo)进行格式化(hua)约定,且未履行适当及合理的提示义务,部(bu)分(fen)托运合同甚(shen)至存在“托运不論(lun)死活(huo),宠物主風(feng)險(xian)自负”等不合理减轻平台、承运人责任的条款,影响托运人的合法权益(yi)。

平台公司应当優(you)化宠物托运合同,完善条款提示方式,采用加粗等合理方式予以说明,避(bi)免不合理减轻平台、承运人责任的条款,确保(bao)合同条款合法有效(xiao)。
